1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law. Let it be known that the use of scripts, bots, or any other means, to automatically add a user to the Addtrain of MobsterStrategy.com, is a violation the Terms of Service and will be enforced accordingly. Violators found exploiting the intended use of this service will not be tolerated and will be prosecuted to the fullest extent of the law allowed by state for damages resulting from said violation.

1. Use License

• 1. Permission is granted to temporarily download one copy of the “materials” (information, software, macros, bots, etc.) on MobsterStrategy.com’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
     1. modify or copy the materials;
     2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
     3. attempt to decompile or reverse engineer any software contained on MobsterStrategy.com’s web site;
     4. remove any copyright or other proprietary notations from the materials; or
     5. transfer the materials to another person or “mirror” the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by MobsterStrategy.com at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
  3. This license does not allow for links to your website via Iframe, Frame, Table, programs, etc. with intentions as claiming MobsterStrategy.com as your own. Doing so constitutes a violation of the Terms and will not be tolerated.

1. Disclaimer

MobsterStrategy.com makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, MobsterStrategy.com does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
  2. By acknowledging this agreement, you understand that the use of “materials” may not be allowed for their intended use and that any damages arising from said use are taken at your own risk. MobsterStrategy.com will not be held responsible for any damages incurred from use of the “materials” and it is agreed that MobsterStategy.com, its owners, and staff will be held harmless in the event that actions are taken and without refund.

Furthermore, by acknowledging this agreement with the understanding that said use of the “materials” are at your own risk, you understand that possible adverse actions include, the suspension, banning or deletion of your MySpace Mobsters and/or MySpace proper account. In the event this occurs, it is agreed that MobsterStategy.com Administration, management, staff, and volunteers will be held harmless and without liability.

1. Limitations

In no event shall MobsterStrategy.com or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials (macros, bots, etc.) on MobsterStrategy.com’s Internet site, even if MobsterStrategy.com or a MobsterStrategy.com authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

1. Termination

You agree that MobsterStrategy.com, in its sole discretion, may terminate your password, posts, or account, and remove and discard any content within the Service, for any reason, including and without limitation, the lack of use, or if MobsterStrategy.com believes that you have violated or acted inconsistently with the letter or spirit of the TOS. Any contracts, verbal or written or assumed, in conjunction with your deleted account and all its parts, at MobsterStrategy.com’s discretion, will be terminated as well. MobsterStrategy.com may also, in its sole discretion and at any time, discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that MobsterStrategy.com may immediately deactivate or delete your MobsterStrategy.com account and all related information and files. MobsterStrategy.com reserves the right to bar any further access to such files or the Service. You agree that MobsterStrategy.com shall not be liable to you or any third-party for any termination of your access to the Service.

1. Member Conduct

You understand that all Content, including without limitation, all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. MobsterStrategy.com does not control Content posted via the Service and, as such, does not guarantee the validity of such Content. You also understand that by using the Service, you may be exposed to Content that is offensive, indecent, or objectionable. Should Content be found or reported to be in violation with, but not limited to, the following terms, it will be MobsterStrategy.com’s sole discretion as to what action should be taken.

You agree to NOT use the Service to:

Upload, post or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive to another’s privacy (up to, but not excluding any address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially, ethnically or otherwise objectionable;
   2. Harm minors in any way;
   3. Impersonate any person or entity, including, but not limited to, a MobsterStrategy.com staff member or volunteer, or falsely state or otherwise misrepresent your affiliation with MobsterStrategy.com or any other person or entity;
   4. Upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
   5. Upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
   6. Upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
   7. Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
   8. Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
   9. “Stalk” or otherwise harass another person or company;
   10. Collect or store personal data about other users for business purposes;
   11. Promote or provide instructional information about illegal activities, promote physical harm or injury against any governmental entity, group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades, and other weapons or incendiary devices;
   12. Use MobsterStrategy.com as a forwarding service to another website;
   13. Allow usage by others in such a way as to violate MobsterStrategy.com’s TOS;
   14. Engage in commercial activities within MobsterStrategy.com or on behalf of MobsterStrategy.com without prior approval. This includes, but is not limited to, the following activities:
       1. Displaying a banner that is designed to profit you or any other business or organization; and
       2. Displaying banners for services that provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their web sites.
   15. Employ tactics to prevent the full and complete display of advertisements on MobsterStrategy.com pages.
   16. Solicit passwords or personal identifying information for unintended, commercial or unlawful purposes from other users.
   17. Exceed the scope of the Service that you have signed up for; for example, accessing and using features that you do not have a right to use, or deleting, adding to, or otherwise changing other people’s entries or other content when you have not been granted the privileges to do so.
   18. Use of any chat or forums to distribute “Warez, Music, or Videos” that under any form of Copyright and/or Trademark.

If MobsterStrategy.com determines, in its sole and absolute discretion, that any user is in violation of the TOS, MobsterStrategy.com retains the right to terminate such user’s account at any time without prior notice.

1. Revisions and Errata

The materials appearing on MobsterStrategy.com’s web site could include technical, typographical, or photographic errors. MobsterStrategy.com does not warrant that any of the materials on its web site are accurate, complete, or current. MobsterStrategy.com may make changes to the materials contained on its web site at any time without notice. MobsterStrategy.com does not, however, make any commitment to update the materials.

1. Volunteers and MobsterStrategy.com

MobsterStrategy.com appreciates the significant contributions made by volunteers, who assist MobsterStrategy.com in its efforts to provide high quality, community driven online services. To help achieve this goal, MobsterStrategy.com volunteers perform a variety of technical and non-technical tasks, including, but not limited to, programming, the creation of web-based content, graphic design, audio and/or visual content creation, technical writing, managing electronic data libraries and/or databases, technical support, reviewing, categorizing, legal assistance, archiving and/or forwarding electronic data, providing expert advice, administration, management, accounting, research, content creation, promotions, or other assignments, as needed. All volunteers are expected to be of legal age, or volunteering with the consent of a legal parent or guardian.

By accepting these TOS, any MobsterStrategy.com member agrees that the intellectual Content created as a result of volunteer work for MobsterStrategy.com constitutes intellectual property of MobsterStrategy.com and that all rights in said Content shall vest in MobsterStrategy.com at the time that it is created, to the extent permitted by law. If laws prevent such vesting, the volunteer makes assignment of all such rights to MobsterStrategy.com at the time of creation. If laws prevent such assignment, the volunteer grants a perpetual worldwide irrevocable license to MobsterStrategy.com to use said Content. If laws prevent such licensing, the volunteer agrees never to sue MobsterStrategy.com for the use of said Content.

The volunteer certifies that any electronic data he/she submits is his/her work and that to the best of the volunteer’s knowledge, the electronic data is not claimed by another. The volunteer agrees to insure that any work provided is correct, error free and does not contain any inflammatory language, indecency or obscenities. Furthermore, if said work is found to be illegally presented, claimed, or forged, MobsterStrategy.com may remove such material and, at MobsterStrategy.com’s discretion, seek action against the individual(s) from which the work originated. No MobsterStrategy.com user is required to become a volunteer to this Service, and users without volunteer status will receive reasonable support and attention as well. Volunteers agree to never to ask for a user’s personal information without just cause and without the permission of MobsterStrategy.com Management Staff. If such information is required the volunteer agrees to not use the information for any malicious purpose, and/or personal or commercial gain. Furthermore, it is understood that said user information will be disposed once used for the approved cause. Without the expressed written confirmation to the contrary, all MobsterStrategy.com positions are assumed to be taken without pay or future consideration.

1. Special Admonition for International Use

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

MobsterStrategy.com has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by MobsterStrategy.com of the site. Use of any such linked web site is at the user’s own risk.

MobsterStrategy.com may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

Any claim relating to MobsterStrategy.com’s web site shall be governed by the laws of the State of Nevada without regard to its conflict of law provisions.
